Foreclosure Administrative Order-10-22-2024

Communications with the Court regarding scheduling of hearings, submission of proposed orders, motions (emergency) to cancel sales and other matters regarding residential foreclosure cases shall be made with Danielle Alleyne, Foreclosure Staff Assistant for Divisions FC-A, FC-C, FC-D, FC-E, FC-F and FC-G.  Please see Division Judges’ procedures for Divisions FC-B and FC-H.

Foreclosure Divisions designation on cases: i.e. FC-A, FC-B, FC-C, FC-D, FC-E, FC-F, FC-G, and FC-H shall be included on all pleadings, motions, notices, proposed orders and cover letters.

Motions (and emergency) to Cancel Sales shall be provided at the earliest possible time to allow adequate time for review and action.

Many uncontested motions do not need to be set for a hearing. Such matters may include motions to appoint a GAL, amend the complaint or other pleading, grant leave for or facilitate service of process or schedule or cancel a sale. Motions to Disburse Surplus Proceeds should normally be noticed for hearing.
 
Submission of proposed orders to the Foreclosure Staff Assistant shall be made through the State of Florida’s e-filing portal.  The standard protocol for submitting such proposed order shall be followed.
 
  
ALL PROPOSED ORDERS MUST INCLUDE THE FOLLOWING:

  1. A cover letter indicating what the Order is for... i.e. hearing (including the hearing date), dismissal, consent order, etc. The cover letter should also indicate if it is consented to or objected, and that all parties are copied with same. The Order only should be in Word format. PLEASE DO NOT PROVIDE PROPOSED ORDERS THROUGH THE E-PORTAL AND BY EMAIL - sending it both ways causes duplication.

  2. A consented or agreed to order should have in the caption “Consent” or “Agreed”, or it should have both or all parties’ signatures.

  3. Service list should contain appropriate email or USPS addresses for all parties to be copied on.

  4. When a Proposed Order has been submitted and there are unrepresented parties not receiving service through the e-portal, the attorney submitting the order is responsible for mailing copies to any and all non-represented parties and filing a Notice of Service.

Residential foreclosure proceedings are conducted in Courtroom 510 of the Duval County Courthouse for Divisions FC-A, FC-C, FC-D, FC-E, FC-F, and FC-G.

Appearances at foreclosure proceedings in Courtroom 510 may be in person or virtually through the https://zoom.us platform.
